Acho que nem vale a pena comentar, discutir legalmente e/ou ir para arbitragem ou para os tribunais. A justificação é claramente uma desculpa legal esfarrapada para negar o dominio e para fugir com o rabinho à seringa, não vá alguém no Governo depois ter de vir mandar umas cacetadas na FCCN.

Summary
-----------

1. (S/NF) Ambassador Hoffman's meeting with Foreign
Minister Amado on September 8 covered the waterfront of
issues. The Minister said that he would push hard with the
Prime Minister to allow Lajes to be used as a transit point
in repatriating Guantanamo detainees (ref a). During recent
closed testimony before the Portuguese Parliament, he did not
diverge from his predecessor's position that the Portuguese
government was not aware of any CIA flights on/through
Portugal (ref b). He highlighted the EU's increased
involvement in the Middle East, calling for greater
engagement with Syria to isolate Iran. Amado said he would
encourage other members of the Community of
Portuguese-speaking Nations (CPLP) to vote for Guatemala for
the UNSC. Amado reiterated his request to meet with
Secretary Rice as soon as possible to discuss the Guantanamo

Transit at Lajes for Detainee Flights
-------------------------------------------
2. (S/NF) Ambassador Hoffman gave the Foreign Minister a
copy of President Bush's Sept. 6 speech on the Global War on
Terrorism, noting the President's desire to be transparent
and to address the suspended state of many Guantanamo
detainees. He asked the Minister if the USG could use Lajes
as a transit point for flights returning detainees to their
home countries, per ref a. Minister Amado said that he
needed to check with the Prime Minister who would be
difficult to convince, but that he would push hard for
Portuguese cooperation so long as there was total
transparency. Details would need to be worked out; there
would need to be a clear political approach. He underscored
that there could be tremendous negative fallout if this was
not done right. The timing was not ideal on the heels of his
Sept. 5 testimony on CIA flights. He promised to provide an
interim answer next week. He said that he needed to meet
with Secretary Rice to discuss this and a host of related
issues.

3. (S/NF) Amado said that the return of Guantanamo detainees
would be an excellent opportunity for the USG to "turn the
page" and to begin working on a new human rights image.
Europe understood the USG reaction to the horrific events of
9/11, but it was time to return to normalcy since effective
security measures had been put in place. He noted that Europe
and the US shared a value system and that this initiative
provided an excellent base upon which to rebuild the
framework of cooperation.

Testimony on CIA Flights
-------------------------------
4. (C) Minister Amado said that his Sept. 5 closed-door
testimony on CIA flights before Portugal's Parliament did not
diverge from his predecessor's position that the Portuguese
government was not aware of any CIA flights on/ through
Portuguese soil. Amado commented, "I said what (Freitas do
Amaral) said." He also reiterated the government's
willingness to revamp the legal framework for the clearance
process. He added that Freitas do Amaral had sent a letter
to the European Parliament's Temporary Committee
investigating CIA flights in response to its inquiries.
Amado commented that the media had misquoted him when it said
that he had acknowledged CIA flights. All he said was that
he had the same list of flights as Eurocontrol had.

5. (C) In addition to European Parliament agitation on this
issue, Amado expressed a need to control his own Socialist
Party. He said there was not a broad consensus within the
party to pursue a strong transatlantic foreign policy and
that there was concern that the "left wing" within the party
could break away in response to the government's handling of
human rights and security issues.

6. (C) Ambassador Hoffman assured Amado that the US was very
careful to abide by all its agreements with Portugal - in
word and in spirit - and that the Ambassador had shared all
the information he had on the subject with Amado.

Underscoring USG position on Middle East
--------------------------------------------- -------
7. (C) Ambassador Hoffman thanked Amado for his pro-active
role within the EU during the recent conflict in Lebanon and
for Portugal's contribution to UNIFIL. He urged Portugal to
encourage continued EU coordination on Middle East policy,
underscored the four principles guiding US policy on Syria,
and reiterated the importance of diplomatically isolating
Iran. He asked that Portugal encourage other EU members to
do the same and that Portugal inform Post in advance of any
official meetings with controversial figures.

EU's New Role
-------------------
8. (C) Amado commented that at the beginning of August, the
EU had "nothing to say" on developments in the Middle East,
and that many member-states were afraid that the conflict in
Lebanon would spiral out of control. A month later, the
Council of Ministers had met three times and agreed to pursue
a greater political and military role - beyond the
traditional role of providing development and humanitarian
assistance. Amado underscored that there was a strong desire
within the EU to coordinate initiatives with the US so as not
to open a new rift in the transatlantic relationship. He
said the EU needed "to coordinate internally, with the US and
with Russia" on finding solutions to the Middle East's many
problems.

Amado says - Engage Syria, Isolate Iran
--------------------------------------------- ------
9. (C) Amado said that Iran posed the greatest threat since
WWII - alluding to the country's growing influence in the
Middle East, the spread of Islamic fundamentalism, and its
nuclear program - and underscored the need for all sides to
work together on solving the problem. (Note: He did not
offer any concrete examples.) He agreed with the USG's four
basic principles on Syria. However, he added, the EU thought
it was important to engage Syria, and that by doing so, the
West would be in a better position to isolate Iran. On the
other hand, if the West isolated Syria, it would push the
country further into Iran's sphere of influence. He noted
that officials from Finland, Greece, Germany and Spain had
recently met with Syrian officials, and he encouraged the US
to have greater political contact with Syria. He said that
he had agreed to meet with Syrian Foreign Minister Bilal
after learning that several Socialist Party members had
already agreed to do so (ref c) .

10. (C) Amado said that the EU wanted to isolate Iran by
enhancing the role of the Arab League in drawing a
distinction between Arab and Islamic identity. Limiting the
spread of Islamic fundamentalismhe declared, could limit
Iran's influence in the Muslim world. He did not buy into
any of the claims by Syrian Information Minister Bilal that
the US was to blame for all the Middle East's woes,
underscoring to Bilal the strong US-Portuguese alliance and
the strong role the US played in the global arena. He urged
Syria to focus on the issues, not play the blame game.

Urging the CPLP to support Guatemala
--------------------------------------------- ---
11. (C) The Ambassador encouraged Portugal to reach out to
the Lusophone community to urge support for Guatemala's
election to the UNSC. Amado said he planned to do so when he
meets with members of the Community of Portuguese Speaking
Nations (CPLP) in New York later this month. Amado would
not confirm an official visit by Hugo Chavez to Portugal
later this year (ref d). While admitting that they could
not hold him off forever, Amado commented that no
arrangements had been made to receive Chavez. He added that
he had recently met with Brazilian President Lula, who he
thought could offer useful insight into dealing with
Venezuela. Portugal planned to have greater dialogue with
Lula should he win reelection. He emphasized the need for
strong US engagement with Brazil to manage the Venezuela
situation.

Comment
-----------
12. (S/NF) As usual, this was a very friendly and
broad-ranging discussion. Amado is very pro-American and
extremely accessible. He was strongly supportive of our
request to use Lajes as a refueling/transit point for Gitmo
detainees being returned to their home countries and was
prepared to press the Prime Minister for an expeditious and
positive response, so long as we continue to be fully
transparent with the GOP about the flights.

Le site de révélation de documents secrets WikiLeaks dispose de trois nouvelles adresses internet néerlandaise, allemande et finlandaise. Cette annonce faite sur Twitter fait suite à celle, plus tôt vendredi, faisant part d'une nouvelle adresse en Suisse. En soirée, celle-ci a momentanément cessé de fonctionner.

1. (S/NF) Summary: Portugal's Foreign Minister offered to 
resign if opposition forces can demonstrate any complicity on 
the part of the government regarding alleged illegal CIA 
rendition flights through Portuguese territory. While a 
government investigation has refuted these allegations, the 
saga continues due to continued opposition party and European 
Parliament pressure. This pressure complicates the US 
request to repatriate Guantanamo detainees via Portugal. End 
summary. 

2. (U) Ongoing pressure from Portugal's Left Bloc and from 
the European Parliament led to a testy exchange in Portugal's 
Parliament on October 18, in which Foreign Minister Luis 
Amado offered to resign if the opposition could prove 
Government of Portugal (GOP) complicity with the USG 
regarding alleged illegal CIA flights violating Portuguese 
sovereignty. 

3. (U) Amado's most recent testimony reflected that of his 
predecessor, Diogo Freitas do Amaral in December 2005 (Ref A) 
and his own earlier testimony on September 5 this year, 
noting the GOP had completed an investigation that discovered 
no information to support allegations that CIA flights 
violated Portugal's territory or airspace to transport 
terrorism suspects. Amado told the Parliamentary Committee 
that "None of the explanations or data collected... 
constitutes a credible indication that the law may have been 
broken on Portuguese soil." He went on to tell reporters 
that a joint investigation by four government departments, 
also involving the country's intelligence agencies, 
immigration service and flight control authorities, conducted 
a review of plane movements but found no firm evidence." 
Amado admitted that the alleged CIA flights might have come 
through Portugal, but added that Portugal "has nothing to be 
ashamed of." According to the Minister, there is no evidence 
that the CIA committed illegal acts in Portuguese territory 
and even stated that he has had nothing but "total 
transparency and cooperation" from American authorities. 

4. (U) Freitas do Amaral had offered the government 
investigation as a way to address the allegations. The 
results, however, have not silenced the GOP's critics, 
especially in the Left Bloc or the European Parliament. 
Portugal's Parliament has established an ad hoc committee 
to continue hearings on the subject and a delegation from the 
European Parliament is scheduled to visit Portugal in 
December to interview Amado, who has declined to visit 
Brussels to meet with Euro Deputies. 

Effect on Repatriation Request 
------------------------------ 
5. (S/NF) Amado's testimony reflects the continued political 
and media pressure on the GOP regarding this subject and 
makes the GOP's efforts to assist in repatriation of 
Guantanamo detainees all the more difficult. It is critical 
that Washington readers recognize the GOP's need to ensure 
that it is on solid legal ground regarding our request on 
detainees. 

6. (S/NF) Portuguese law, as interpreted by the GOP (which 
could change), requires written assurance by the final 
destination country that detainees will not be tortured or 
receive the death penalty as well as a US guarantee that they 
will be treated according to internationally-recognized 
conventions in the destination country. Without these 
assurances, the GOP will have difficulty n supporting 
repatriation flights through Portuguese territory or 
airspace. We eagerly await Washington addressees response to 
the Portuguese points as discussed Ref C. The GOP will 
undoubtedly expect this issue to be discussed at the October 
24 meeting between Amado and Secretary Rice in Washington. 

The Media 
--------- 
7. (U) The local press eagerly reprints hearsay on this 
tantalizing subject as left wing politicians unveil "new 
facts" every few days to fan the political fires. Post 
believes the media will continue to sensationalize the issue 
as long as it has legs. 

Comment 
------- 
8. (S/NF) The normally unflappable Amado lost his cool during 
the testimony; an event that is completely out of character 
and shows the effects of unrelenting media and political 
attacks. Despite this outburst, we believe Amado will 

continue to reiterate what the investigation has revealed - 
the government has no evidence of illegal CIA flights 
on/through Portuguese territory. However, Post underscores 
the delicate balancing act Amado is confronting in minimizing 
damage to his government - however unwarranted - due to the 
CIA Rendition investigation while trying to convince it to 
grant our request to repatriate Guantanamo detainees through 
Lajes. Right now, it would be to our advantage to stroke him 
a lot.

Hillary Clinton mandou diplomatas fazer papel de espiões

Os Estados Unidos exigem aos seus diplomatas que desempenhem um papel de espião, obtendo por exemplo o número dos cartões de crédito de responsáveis estrangeiros, segundo documentos secretos difundidos no domingo pelo site de Internet WikiLeaks.
Entre os 250.000 documentos da diplomacia norte-americana, revelados através dos diários norte-americano New York Times e britânico The Guardian, figuram várias missivas dirigidas a embaixadas, nas quais Washington reclama missões geralmente associadas ao trabalho da CIA.
Uma directiva secreta assinada em Julho de 2009 pela secretária de Estado, Hillary Clinton, reclama detalhes técnicos sobre as redes de comunicação utilizadas pelos responsáveis das Nações Unidas, como palavras passe e códigos secretos.
Esta "directiva nacional sobre a recolha de informações humanas" foi enviada às embaixadas norte-americanas da ONU em Nova Iorque, Viena e Roma, bem como a 33 embaixadas e consulados no Médio Oriente, na Europa de Leste, na América Latina e África.
Segundo o New York Times, o documento pede igualmente aos diplomatas norte-americanos destacados em Nova Iorque "informações biográficas e biométricas sobre diplomatas norte-coreanos de alta patente".
O Guardian precisa que a directiva pede informações sobre "o estilo de trabalhar e de tomar decisões" do secretário geral da ONU Ban Ki-moon.
Washington reclama informações muito precisas sobre funcionários da ONU: números de cartões bancários, endereços electrónicos, números de telefone e mesmo os números de cartões de fidelidade de companhias aéreas, indicou o diário londrino.
Uma directiva similar, assinada em Abril de 2009, por Hillary Clinton reclama detalhes sobre personalidades de três países africanos: República Democrática do Congo, Ruanda e Burundi.
O departamento de Estado pede dados relativos a responsáveis nos domínios políticos, militares, comerciais ou da informação.
Estes dados deverão atestar "o seu estado de saúde, a sua opinião sobre os Estados Unidos, a sua formação, a sua origem étnica e o seu controlo de línguas estrangeiras", precisa Washington.
Mas os Estados Unidos reclamam também "impressões digitais, fotografias do rosto, amostras de ADN e imagens digitalizadas da íris".
Os diplomatas colocados na região dos Grandes Lagos deverão fornecer informações sobre diferentes equipamentos ou instalações militares como aeródromos.
Num texto dirigido à sua embaixada em Sófia, Washington pede detalhes sobre "as relações entre líderes búlgaros e responsáveis ou empresários russos", segundo o New York Times.
Uma directiva dirigida aos postos diplomáticos do Cairo, Telavive, Jerusalém, Aman, Damasco e Riade reclamou informações sobre os veículos e os itinerários projectados de altos responsáveis do Hamas e da Autoridade palestiniana.
Segundo o Guardian, as embaixadas dos Estados Unidos na África central foram solicitadas para fornecer elementos sobre as relações entre os países da região e a China, a Líbia, a Coreia do Norte, o Irão e a Rússia, sobretudo no que diz respeito às vendas de armas e de urânio.
O porta-voz do departamento de Estado, Philip Crowley, assegurou que os seus colegas não são espiões.
"Contrariamente a certas informações do WikiLeaks, os nossos diplomatas são diplomatas. Não são auxiliares em matéria de informação", assegurou no Twitter.

WikiLeaks va avoir de la concurrence. Alors que ce site rend fous de rage les services diplomatiques d'une bonne partie de la planète, une initiative vise à contrer le pouvoir grandissant dont il jouit, et, en parallèle, son icône de plus en plus charismatique, le journaliste australien Julian Assange. Selon les informations du Point, celle-ci devrait être dévoilée autour de la mi-décembre, à Berlin.
Surprise, cette initiative vient des anciens compagnons de route d'Assange, dont certains étaient à ses côtés il y a encore trois mois. Et notamment de Daniel Domscheit-Berg, qui fut le porte-parole de WikiLeaks durant plus de deux ans et demi sous le nom de Daniel Schmitt. C'était avant d'en claquer bruyamment la porte, à la mi-septembre, tandis qu'Assange avait décidé de le suspendre un mois. Domscheit-Berg venait de reprocher à Assange de se conduire "comme un empereur".
Mascarade
Depuis, Domscheit-Berg estime qu'il est temps de créer une alternative à WikiLeaks. Il a été rejoint, dans cette nouvelle aventure, par Herbert Snorasson, un jeune Islandais passionné d'histoire. Il bénéficiera aussi du soutien de la députée islandaise Birgitta Jonsdottir, qui estime que le site a perdu son âme. D'après Domscheit-Berg, WikiLeaks a notamment viré au "culte de la personnalité", le jeu de cache-cache d'Assange avec la CIA n'étant qu'une mascarade. "Si les services américains voulaient vraiment arrêter Assange, ils l'auraient fait depuis longtemps."
Ces dissidents reprochent par ailleurs au site de ne pas suffisamment respecter la confidentialité des sources. Un débat avait fortement secoué l'équipe de WikiLeaks au moment de la révélation des documents sur la guerre en Afghanistan : le nom de certains informateurs, qui apparaissant au grand jour, n'avaient pas été floutés, ce qui les mettait à la merci de représailles.
Le FBI dans le coup ?
Pourtant, plus qu'un clone de WikiLeaks, ce site devrait donner à n'importe quelle organisation, comme à tout particulier qui le désire, la possibilité de publier des informations "sensibles". Domscheit-Berg précise que cette initiative mobilisera au minimum 10 personnes, dont plusieurs à la technique. Le statut juridique sera celui d'une fondation, au départ basée en Allemagne, avec un conseil d'administration dont l'identité des membres sera publique.
Une initiative initiée en sous-main par le FBI pour contrer WikiLeaks ? "En aucune manière", se défend Domscheit-Berg, un peu énervé que l'on puisse remettre en cause le bien-fondé de sa nouvelle initiative, qui, selon lui, va renforcer l'information dans la démocratie.

The King of Saudi Arabia privately urged the United States to attack Iran to destroy its nuclear weapons programme, according to diplomatic cables leaked by the whistle-blowing website, WikiLeaks.

The first tranche of more than 250,000 classified cables released by the WikiLeaks site says American officials were also told to spy on the United Nations’ leadership and get biometric information on its secretary general Ban Ki-moon.
The cables detail claims of inappropriate behaviour by a member of the Royal family and criticism of Britain’s military operations in Afghanistan and David Cameron.
The cables include requests for “specific intelligence” about British MPs. The communiques last night threatened a global diplomatic crisis and put America’s relations with Europe and the Middle East under a cloud.
The leaked memos also disclose how American diplomats compared Iran’s President Ahmedinejad with Adolf Hitler and labelled France’s President Nicolas Sarkozy as the “emperor with no clothes”.
The German Chancellor Angela Merkel was depicted as “risk aversive”, while the Russian prime minister Vladimir Putin was an “alpha dog”. Afghanistan’s president Hamid Karzai was “driven by paranoia”. The unguarded comments were contained in the classified cables from US embassies, details of which were published by several newspapers on the internet last night. Some of the cables were sent as recently as last February.
The first package of memos published by The Guardian, the New York Times and Germany’s Der Spiegel failed to name the British Royal or the behaviour. The cables are being released over the coming fortnight, rather than all at once, putting America’s foreign relations under unprecedented pressure.
One of the most damaging allegations was that Saudi Arabia’s King Abdullah repeatedly urged America to attack Iran.
The Saudi leader was recorded as having “frequently exhorted the US to attack Iran to put an end to its nuclear weapons programme”.
The leak said he told the Americans to “cut off the head of the snake” at a meeting in 2008. The leaks also disclose how leaders in Saudi Arabia, the United Arab Emirates and Egypt referred to Iran as “evil” and a power that “is going to take us to war”.
The papers also claimed that the US Government was running a secret intelligence campaign targeted at Mr Ban and the permanent security council representatives from China, Russia, France and the UK. They alleged that the US Secretary of State, Hillary Clinton, called for biometric information on the UN secretary general.
A classified directive was issued to US diplomats under the name of the secretary of state in July last year, asking for forensic technical details about the communications systems used by top UN officials, including passwords and personal encryption keys used in private and commercial networks for official communications.
American diplomats were also asked to compile a profile of Alan Duncan, the homosexual former oil trader who is now the international development minister.
The Americans particularly asked for information on the relationship between Mr Duncan and William Hague, the Foreign Secretary, with whom he used to share a flat, and also Mr Cameron.
The US administration also wanted information “on key UN officials, to include under-secretaries, heads of specialised agencies and their chief advisers” as well as intelligence on Mr Ban’s “management and decision-making style”.
Washington asked for credit card numbers, email addresses, phone, fax and pager numbers and even frequent-flyer account numbers for UN figures and “biographic and biometric information on UN Security Council permanent representatives”. The secret “national human intelligence collection directive” was sent to US missions at the UN in New York, Vienna and Rome as well as 33 embassies and consulates, including those in London, Paris and Moscow.
Some of the cables offered personal and highly embarrassing descriptions of other world leaders. Kim Jong-il, of North Korea, was said to suffer from epileptic fits, while President Medvedev of Russia was “hesitant”.
The documents also claimed that Italy’s prime minister, Silvio Berlusconi, was known for his “wild parties” while Libya’s president Muammar Gaddafi had a “sumptuous blonde as a nursing sister”.
Barack Obama was reported to want to “look East rather than West” while feeling no emotional connection towards Europe.
Washington tended to view the world in terms of two super powers with the European Union playing a secondary role, the cables said.
According to a review of the WikiLeaks documents published in the New York Times, Saudi donors were chief financiers of militant groups such as al-Qaeda and Chinese government operatives had waged a campaign of computer sabotage targeting the United States and its allies.
The WikiLeaks website suffered its own “cyber attack” hours before the release of the documents, with unknown hackers trying to stop the publication.
The White House last night condemned the “reckless and dangerous action” in releasing the classified US diplomatic cables, saying it could endanger lives and risk relations with friendly countries.
Robert Gibbs, a White House spokesman, said: “When the substance of private conversations is printed on the front pages of newspapers across the world, it can deeply impact not only US foreign policy interests, but those of our allies around the world.”
A Foreign Office spokesman said: “We condemn any unauthorised release of this classified information, just as we condemn leaks of classified material in the UK.
“We have a very strong relationship with the US government. That will continue”.
Buckingham Palace said it had no information about any allegations of inappropriate behaviour by a member of the Royal family.
It is not known who was the source of the leak, however there has been speculation that it could have come from Bradley Manning, a US Army soldier, who has been accused of leaking and transmitting national security information.
He was charged in July.
It also emerged that Julian Assange, the founder of WikiLeaks, had been rebuffed by the US government after he sought information “regarding individuals who may be 'at significant risk of harm’ because of” his planned release of classified documents.
His unusual move to open an 11th-hour dialogue about the documents came after a Swedish appeals court last week upheld an arrest warrant on rape charges for Mr Assange, validating an international warrant.
Mr Assange, who denies he has committed any crime, was believed to have recently spent time in London but his whereabouts yesterday were unknown. He had been under investigation in Sweden since August over rape.
One report said that Wikileaks had 251,287 cables from 270 US embassies and consulates from a single computer server.
The leaked documents went on to make further allegations. They claimed that Iran had obtained missiles from North Korea to give it the capacity to launch strikes on capitals in Western Europe for the first time.
According to a cable dated last Feb 24, North Korea sent to Iran 19 of the missiles, capable of carrying a nuclear warhead. Intelligence agencies believe Tehran is some way from developing a nuclear warhead. The officials said the deal had significantly advanced Iran’s development of intercontinental ballistic missiles.
Other findings include how since 2007, America had mounted a highly secret effort to remove from a Pakistani research reactor enriched uranium for a nuclear bomb. Frustrations with Pakistan were reflected in reported comments by King Abdullah who called President Asif Ali Zardari the greatest obstacle to progress, adding: “When the head is rotten, it affects the whole body.”
The cables reveal the desperate attempts by the US administration to find homes for former Guantánamo Bay detainees.
In one instance Slovenia was told to take a prisoner if it wanted to meet with President Obama. In another accepting prisoners would be “a low-cost way for Belgium to attain prominence in Europe”.
The cables also detailed suspicions of corruption in the Afghan government after the vice-president was caught with $52 million (£33 million) in cash on a visit to the United Arab Emirates last year.
They also detailed how one state department communiqué had named Saudi donors as the chief financiers of al-Qaeda, while China was engaged in a global effort to hack into Google’s computers.
